For Our Kids Celebrates Victory in Cycle Challenge Case

For Our Kids applauds the Ontario Superior Court’s recent ruling in the Cycle Challenge case, which finds that the Ontario government’s decision to remove bike lanes in Toronto violated Canadians’ Charter rights under Section 7.
For Our Kids Toronto served as an intervener in the case, and we are heartened to know that the team’s argument had an impact in the ruling. In the decision, Justice Schabas says “The Intervener For Our Kids discusses the disproportionate impact of removing the target bike lanes on children. It highlights the benefits to children of making streets safer through the use of bike lanes, which will encourage bicycle use and all of the physical and environmental benefits which follow, arguing that their removal is contrary to the ‘best interests of the child.’ There is no indication the government considered this issue at all.”
The decision goes on to quote For Our Kids Toronto’s submission to the court: “While the legislature is at liberty to make policy that may be ineffective, it is constitutionally not at liberty to put children's lives at risk in pursuit of folly.”
